Terms of Service
Your data, your control
These Terms of Service ("Terms") are an agreement between you and Daywa Software ("Daywa", "we", "us") governing your use of the Daywa mobile application (the "App"). By using the App you agree to these Terms. If you do not agree, do not use the App.
1. What Daywa Is (and Is Not)
Daywa provides personalized astrology- and numerology-based content: daily and monthly readings, birth-chart insights, timing calendars for personal intentions, and related guidance.
Daywa is provided for entertainment, inspiration, and self-reflection purposes only. Daywa content is not, and must not be relied upon as, medical, psychological, legal, financial, investment, or any other professional advice. You are solely responsible for your decisions and actions. Always consult a qualified professional for matters concerning your health, finances, legal affairs, or other significant decisions.
2. Eligibility and Account
You must be at least 13 years old (or the higher minimum age required in your country) to use the App. The App creates an anonymous account identifier for your device; you are responsible for the accuracy of the information you enter (such as birth details), which directly affects the content generated. You may delete your account at any time in Profile → Settings → Delete Account.
3. Free Access and Subscriptions
3.1 Free access
New users receive full or partial free access for a limited period and/or a limited number of feature uses (for example, a limited number of timing-calendar views). The scope of free access is shown in the App and may change over time.
3.2 Subscriptions
Full access to Daywa requires an auto-renewing subscription purchased through Apple:
- Weekly: includes a 3-day free trial for new subscribers; converts to a paid weekly subscription unless cancelled at least 24 hours before the trial ends.
- Monthly and Annual: billed at the price shown in the App at purchase time.
Prices are shown in the App in your local currency via the App Store. Payment is charged to your Apple ID. Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID settings (Settings → Apple ID → Subscriptions). Deleting the App does not cancel a subscription.
3.3 Refunds
Purchases are processed by Apple, and refunds are handled by Apple under App Store terms. We cannot issue refunds directly for App Store purchases.
3.4 Promotional access
We may grant free or discounted access via promotional codes at our discretion. Promotional access may be modified or revoked at any time, is non-transferable, and has no cash value.
3.5 Changes
We may change subscription prices or the features included in each tier. Price changes apply prospectively; where Apple requires, you will be asked to consent before a higher price takes effect.
4. Fair Use
To keep the service fast and affordable, content generation is subject to reasonable fair-use limits (for example, daily generation quotas). We may throttle or refuse requests that exceed these limits or that indicate automated/abusive usage.
5. Acceptable Use
You agree not to: (a) reverse-engineer, scrape, or access the service by any means other than the App; (b) attempt to bypass access controls, quotas, or payment requirements; (c) resell or commercially exploit the content without our written consent; (d) use the App in violation of applicable law.
6. Intellectual Property
The App, its design, and its underlying systems are owned by us or our licensors. Content generated for you may be used for your personal, non-commercial purposes. We retain all other rights.
7. Third-Party Services
The App relies on third-party services (including astrological computation providers, AI text-generation providers, and Apple) to deliver content and process payments. We are not responsible for interruptions caused by third-party services, though we work to minimize their impact.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT CONTENT WILL BE ACCURATE OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. ASTROLOGICAL AND NUMEROLOGICAL CONTENT HAS NO SCIENTIFICALLY PROVEN PREDICTIVE VALUE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DECISIONS MADE OR ACTIONS TAKEN IN RELIANCE ON APP CONTENT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, AND NOTHING AFFECTS STATUTORY CONSUMER RIGHTS.
10. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate access for breach of these Terms, abuse of the service, or where required by law. Upon termination, sections that by their nature should survive (including 6, 8, 9, 12) survive.
11. Changes to These Terms
We may update these Terms. Material changes will be announced in the App or on this page with an updated date. Continued use after changes means acceptance.
12. Governing Law and Disputes
These Terms are governed by the laws of [JURISDICTION, TO BE DETERMINED UPON COMPANY INCORPORATION], without regard to conflict-of-law rules. Disputes shall be resolved in the courts of [JURISDICTION, TO BE DETERMINED UPON COMPANY INCORPORATION], unless mandatory consumer-protection law in your country of residence provides otherwise.
